Introduction

Since the signing of the Consent Decree in 1985, a constant debate between the parties to the consent decree and the citizens of Monroe County has taken place concerning the legality of the consent decree. Citizens and local citizen's groups like COPA have filed suit over issues related to the Consent Decree.

Although todate the courts have not given the people their day in court, these suits provide a detailed summary to what many believe to be flaws in the original consent decree and activities that have taken place since the signing of the consent decree. It is important to remember the courts have not ruled on the issues of these legal arguments!

  • COPA 60B - Joint Amended Motion for Relief from Judgement Approving Consent Decree & Denying InPIRG's Motion to Intervene. This legal effort was initiated by COPA to counter information presented by the parties to the Consent Decree and to have that document invalidayed. (Text file: 42K)
  • COPA60B Reply - COPA's Reply to Opposition to its 60B Motion to Vacate the Consent Decree. Much additional support for COPA's position in opposition to the Consent Decree is presented. (Text file: 61K)
